1. Contractual Framework & Acceptance

This web platform is owned, maintained, and operated by P. Ramesh. Throughout the digital platform, the expressions "Firm", "we", "us", and "our" refer specifically to P. Ramesh. By accessing this site, browsing our product catalog, utilizing any integrated application programming interface (API), or finalizing a purchase, you enter into a legally enforceable commercial agreement and agree to be bound by these Terms and Conditions.

If you do not accept these terms in their entirety, you must discontinue your use of this digital portal immediately.

2. User Eligibility & Declarations

By consenting to these Terms, you warrant and represent that you have reached the age of majority within your domestic jurisdiction and possess full legal capacity to enter into binding fiscal contracts under the Indian Contract Act, 1872. 3. Textile Realism, Display Variances & Specifications

P. Ramesh specializes in premium, artisanal, handcrafted, and natural silk textiles. You acknowledge and accept that:

●       Handwoven fabrics, natural silk yarns, traditional embroideries (such as Zardozi, Aari, and hand-embroidery), and artisanal dyeing techniques (such as Bandhej and Patola) possess natural characteristics, minor slubs, uneven thread density, and organic shade variances that reflect handloom production. These variations are not defects.

●       While color representation has been configured according to rigorous imaging standards, digital displays, mobile screens, and browser render engines interpret color calibrations differently. Variations between on-screen color profiles and real-world dye lots are standard and do not warrant defective claims.

4. Pricing Adjustments, Product Discontinuance & Errors

●       Product listings and market prices are subject to revision without prior notice at our sole discretion.

●       We reserve the unilateral right to correct typographical inaccuracies, pricing oversights, or supply-chain adjustments, and to modify or cancel affected orders even after an order confirmation email has been dispatched.

●       In instances where an order is canceled unilaterally by P. Ramesh due to verifiable stock exhaustion or pricing errors, our entire legal liability is limited strictly to refunding the transacted amount to the originating financial source within five (5) to seven (7) business days.

5. Commercial Purchases & Prohibition on Unauthorized Reselling

We reserve the right to decline, cancel, or truncate orders that, in our assessment, appear to be placed by unauthorized resellers, wholesalers, commercial re-exporters, or syndicates operating outside our formal B2B wholesale framework.

6. Proprietary Rights and Brand Assets

All material found on this platform—including brand names, logotypes, product photographs, styling lookbooks, written copy, artistic graphics, user interfaces, source code, and textile surface designs—is the proprietary intellectual property of P. Ramesh and is protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and international intellectual property conventions. Any unauthorized reproduction, downloading, commercial mirroring, extraction, or framing without our prior written authorization will result in civil actions and criminal complaints.

7. Prohibited Acts & Platform Integrity

Users are strictly prohibited from using the platform or its contents:

●       For any illicit, unlawful, tortious, or defamatory objectives.

●       To solicit others to engage in unlawful acts or bypass taxation frameworks.

●       To deploy any scraping algorithm, automated crawler, spider, or reverse-engineering mechanism to extract catalog assets, pricing information, or customer databases.

●       To upload or transmit malicious script, computer viruses, Trojan components, or code that impairs the platform’s security framework or operational integrity.

8. Disclaimer of Warranties & Absolute Limitation of Liability

This platform, its features, and all products are made accessible strictly on an "as is" and "as available" basis without any express or implied warranties of merchantability, durability, title, or fitness for an idiosyncratic purpose.

To the fullest extent permissible under Indian law, in no event shall P. Ramesh, its partners, executives, associates, employees, or contracted suppliers be liable for any indirect, punitive, special, exemplary, or consequential damages (including, but not limited to, lost business opportunities, reputational harm, or commercial downtime) arising from your use or inability to use the platform or items purchased.

In any dispute, the total financial liability of P. Ramesh to the customer shall not exceed the invoice price paid for the specific item in dispute.

9. Indemnification

You agree to indemnify, defend, and hold harmless P. Ramesh, its partners, agents, directors, employees, and fulfillment contractors from and against any third-party claims, legal liabilities, government penalties, damages, costs, and legal expenses (including reasonable attorney fees) arising from your breach of these Terms, misrepresentation of facts, or violation of any statutory right or law.

10. Governing Law, Judicial Jurisdiction & Arbitration

These Terms, along with all associated website policies, are governed by and construed strictly in accordance with the substantive laws of India. Any commercial dispute, claim, breach, or legal action arising out of these Terms or transactions on this platform shall be subject to the exclusive jurisdiction of the competent courts of law situated in Ahmedabad, Gujarat, India.
